  1. Introduction

These Terms of Service (“Terms”) govern your access to and use of DMAICProcess.AI, including our website, platform, software, tools, templates, AI-assisted features, and related services (“Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services.

  1. Purpose of the Services

DMAICProcess.AI provides digital tools to support business process improvement using DMAIC, Lean Six Sigma, workflow analysis, documentation, reporting, and AI-assisted guidance. The Services are intended to assist professional decision-making, not replace expert judgment, professional review, or legally regulated advice.

  1. Eligibility

You represent that you are legally permitted to enter into these Terms and use the Services in compliance with applicable laws. The Services are intended for business and professional use.

  1. Accounts and Security

You may need to create an account to access certain features. You agree to provide accurate and current information and to maintain the confidentiality of your login credentials. You are responsible for all activity under your account. Notify us immediately of any unauthorized access.

  1. Subscriptions, Billing, and Payments

We may offer free, trial, paid, or custom subscription plans. Pricing, features, usage limits, and renewal terms will be displayed at checkout or otherwise communicated.

Unless stated otherwise:

  • Subscription fees are billed in advance
  • Paid plans may automatically renew
  • You must maintain accurate billing information
  • Taxes may apply
  • Features, limits, or pricing may change without notice

We will disclose renewal terms and cancellation instructions at purchase. You may cancel auto-renewal through your account settings. Refund eligibility depends on the plan, billing method, promotional terms, and applicable law.

  1. Trials and Beta Features

We may offer free trials or beta features. These are experimental, may change at any time, and are provided without warranties or guarantees.

  1. Acceptable Use

You agree not to misuse the Services. Prohibited activities include:

  • Unlawful, harmful, fraudulent, or abusive use
  • Uploading content that violates intellectual property, privacy, or data protection rights
  • Reverse engineering, scraping, or attempting to access source code
  • Interfering with security or performance
  • Circumventing usage limits or access controls
  • Sharing accounts with unauthorized users
  • Uploading malware or harmful code
  • Generating unlawful, discriminatory, or harmful content
  • Using automated systems without permission
  • Presenting AI-generated output as fully verified without human review

We may suspend or terminate access if your use violates these Terms or creates legal, security, or operational risk.

  1. User Content and Data

You retain ownership of the content you upload or create (“User Content”). You grant DMAICProcess.AI a limited license to host, store, process, display, and use User Content solely to operate and improve the Services.

You are responsible for ensuring you have rights to upload and use User Content. While we use reasonable safeguards, we do not guarantee against loss, corruption, or unauthorized access. You should maintain backup copies of your data.

  1. AI-Generated Output

The Services may generate AI-assisted suggestions, summaries, reports, documentation, and other outputs.

You acknowledge and agree that:

  • AI-generated content may be incomplete, inaccurate, or unsuitable
  • All output must be independently reviewed by qualified personnel
  • The Services do not provide legal, financial, medical, engineering, compliance, or professional advice
  • You are solely responsible for decisions and actions based on AI-generated output
  • Results may vary even with similar inputs

DMAICProcess.AI is not responsible for any decisions, actions, losses, or damages arising from reliance on AI-generated output.

  1. Intellectual Property

DMAICProcess.AI owns or licenses all platform technology, software, templates, workflows, branding, and related materials. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for internal business purposes.

You may not copy, modify, distribute, resell, or create derivative works without written permission.

  1. Confidentiality

If you access confidential information through the Services, you must handle it responsibly and use it only for authorized purposes.

  1. Third-Party Services

The Services may integrate with third-party providers (e.g., hosting, payments, analytics, AI engines). We are not responsible for third-party services we do not control. Their terms and privacy policies apply separately.

  1. Service Availability

We aim to provide reliable access but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, DMAICProcess.AI is not liable for losses or damages resulting from downtime, outages, maintenance, or events beyond our control.

  1. Support

Support availability varies by subscription plan. Support may be provided through email, documentation, helpdesk, chat, or other channels.

  1. Security

We implement reasonable safeguards to protect accounts and data. No system is completely secure. You are responsible for strong passwords, device protection, and managing user permissions.

  1. Termination

You may stop using the Services at any time. Paid subscriptions may be canceled through your account or billing provider.

We may suspend or terminate access if:

  • You violate these Terms
  • Payment is overdue
  • Your use creates legal, security, or operational risk
  • Required by law
  • You infringe third-party rights

After termination, your access ends. We may retain or delete data according to our Privacy Policy and legal obligations.

  1. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not guarantee that:

  • The Services meet all requirements
  • AI-generated output is accurate or suitable
  • Process improvements will achieve specific results
  • The platform will be uninterrupted or error-free
  • Defects will be corrected immediately
  1. Limitation of Liability

Nothing in these Terms limits liability where such limitation is prohibited by law.

Where permitted:

  • DMAICProcess.AI’s total liability is limited to the amount paid in the twelve months before the claim, or USD $100 for free users
  • DMAICProcess.AI is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, or business opportunities
  1. Indemnification

You agree to indemnify and defend DMAICProcess.AI against claims arising from your misuse of the Services, violation of these Terms, User Content, or decisions based on AI-generated output.

DMAICProcess.AI will provide prompt notice of any claim. You agree to cooperate in the defense, and DMAICProcess.AI may participate with its own counsel.

  1. Changes to These Terms

We may update these Terms. Material changes will be communicated through the platform or email. Continued use after notice constitutes acceptance of the updated Terms.
