1. Introduction

These Terms of Service (“Terms”) govern your access to and use of DMAICPROCESS.AI, including our website, process-improvement platform, AI-assisted features, project tools, and related services (“Services”).

By creating an account, purchasing a subscription, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Purpose of the Services

DMAICPROCESS.AI provides digital tools designed to support structured business process improvement using the Define, Measure, Analyze, Improve, and Control (“DMAIC”) methodology.

The Services may assist with organizing project information, analyzing data, identifying potential root causes, developing improvement options, documenting project work, and generating AI-assisted outputs.

The Services are decision-support tools. They do not replace qualified professional judgment or advice in areas requiring licensed, regulated, technical, legal, financial, medical, engineering, compliance, or other specialized expertise.

3. Eligibility

You must be legally capable of entering into these Terms and using the Services in compliance with applicable law.

The Services are intended primarily for business and professional use and are not intended for individuals under 18 years of age.

4. Accounts and Account Security

Certain features require an account. You agree to provide accurate information and to keep your account information current.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You should notify us promptly if you believe your account has been accessed without authorization.

5. Plans, Subscriptions, Billing, and Payments

DMAICPROCESS.AI may offer free and paid subscription plans with different project limits, storage limits, AI-assisted features, support levels, and other functionality.

Current pricing, billing frequency, plan features, and applicable limits are displayed on the pricing page and during the registration or checkout process.

If you select a recurring paid subscription, your subscription will renew according to the billing frequency disclosed at checkout unless it is canceled before the next renewal date.

Subscription fees are generally charged in advance for the applicable billing period. Applicable taxes may also be charged where required.

You are responsible for maintaining valid and accurate billing information.

Cancellation options and any applicable refund terms are governed by the information presented at checkout, within your account or billing interface, and any separately published refund or cancellation policy.

We may change plans, features, limits, or pricing from time to time. Changes affecting an existing paid subscription will be handled in accordance with applicable law and any notice requirements that apply.

6. Free and Experimental Features

We may offer free plans, previews, beta features, early-access features, or other experimental functionality.

Experimental features may be modified, suspended, or discontinued and may not operate in the same manner as generally available features.

7. Acceptable Use

You agree not to use the Services to:

• Violate applicable laws or regulations
• Engage in fraudulent, abusive, harmful, or deceptive activity
• Upload material that you do not have the right or authority to use
• Infringe intellectual property, privacy, confidentiality, or other rights
• Upload malware, malicious code, or harmful files
• Interfere with the security, availability, or performance of the Services
• Attempt to gain unauthorized access to accounts, systems, source code, or restricted functionality
• Circumvent plan limits, security controls, or access restrictions
• Scrape, reverse engineer, or systematically extract platform content except where permitted by law or written authorization
• Use the Services to generate or facilitate unlawful or intentionally harmful activity

We may restrict, suspend, or terminate access when reasonably necessary to address violations of these Terms, security threats, fraud, nonpayment, or legal requirements.

8. User Content and Uploaded Information

You retain ownership of information, files, documents, data, and other material that you upload or submit to the Services (“User Content”).

You grant DMAICPROCESS.AI a limited license to host, store, transmit, process, and otherwise use User Content as reasonably necessary to provide, maintain, secure, troubleshoot, and support the Services and to generate the outputs you request.

You are responsible for ensuring that you have the necessary rights, permissions, and authority to upload and process User Content.

You should maintain appropriate backup copies of important source information. Although we use reasonable safeguards, no online service or storage system can guarantee against every instance of loss, corruption, interruption, or unauthorized access.

9. AI-Assisted Outputs

The Services may generate AI-assisted suggestions, summaries, analyses, reports, documentation, and other outputs.

You acknowledge that:

• AI-generated output may contain errors, omissions, or inaccuracies
• AI-generated output may vary even when similar information is provided
• AI output should be reviewed and validated before implementation or reliance
• The suitability of an output depends on the accuracy, completeness, and context of the information provided
• You remain responsible for business, operational, financial, safety, compliance, and other decisions made using the Services

DMAICPROCESS.AI does not guarantee that use of the Services will produce a particular financial, operational, quality, productivity, cost-savings, or other business result.

10. Intellectual Property

DMAICPROCESS.AI and its licensors retain ownership of the platform, software, interfaces, branding, templates, platform-generated design elements, and other intellectual property that is not User Content.

Subject to these Terms and your applicable plan, we grant you a limited, non-exclusive, non-transferable right to use the Services for your business or professional purposes.

Except as permitted by law or expressly authorized by us, you may not copy, resell, sublicense, distribute, reverse engineer, or commercially exploit the Services themselves.

11. Confidential Information

You are responsible for determining whether information you upload may lawfully be submitted to the Services, including confidential, proprietary, regulated, or third-party information.

If you use the Services on behalf of an organization, you are responsible for complying with that organization’s information-security, confidentiality, and data-handling requirements.

12. Third-Party Services

DMAICPROCESS.AI relies on third-party providers for certain functions, which may include hosting, payment processing, artificial intelligence, analytics, security, spam prevention, email, and other infrastructure.

Third-party services may be subject to their own terms and privacy policies. DMAICPROCESS.AI is not responsible for third-party products or services outside our reasonable control.

13. Service Availability

We aim to maintain reliable access to the Services but do not guarantee uninterrupted, error-free, or continuously available operation.

The Services may occasionally be unavailable because of maintenance, upgrades, technical failures, security events, third-party outages, internet disruptions, or circumstances beyond our reasonable control.

Support availability and response priority may vary by subscription plan.

Available support options and plan-specific support features are described on the pricing page or within the Services.

15. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect accounts and information.

No system can be guaranteed to be completely secure. You are responsible for protecting your login credentials, devices, and authorized access to your account.

16. Cancellation, Suspension, and Termination

You may stop using the Services at any time.

Recurring paid subscriptions may be canceled using the cancellation method made available through the Services, billing interface, or support process.

We may suspend or terminate access if:

• You materially violate these Terms
• Required payments remain unpaid
• Your use presents a material security, fraud, legal, or operational risk
• We are required to do so by law
• Your use infringes the rights of others

Following termination or account closure, access to certain Services and stored project information may end. Retention and deletion of information are handled according to our Privacy Policy, legal obligations, and applicable operational requirements.

17. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

DMAICPROCESS.AI disclaims warranties that may otherwise arise by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent such disclaimers are legally permitted.

We do not guarantee that:

• The Services will meet every business or technical requirement
• AI-assisted outputs will always be accurate, complete, or suitable
• Use of the Services will produce a particular business outcome or savings amount
• The Services will always be uninterrupted or error-free
• Every defect or issue will be corrected immediately

18. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

To the fullest extent permitted by applicable law, DMAICPROCESS.AI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from or relating to use of the Services.

Any limitation on the total amount of DMAICPROCESS.AI’s liability should be interpreted and applied only to the extent permitted by applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify DMAICPROCESS.AI against third-party claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Services, your material violation of these Terms, or User Content that infringes the rights of another party.

20. Changes to These Terms

We may update these Terms from time to time. When changes are made, the revised Terms will be posted on this page and the “Last Updated” date will be updated.

Where required by applicable law, we may provide additional notice of material changes.

21. Governing Law and Disputes

The governing law, venue, and dispute-resolution provisions applicable to these Terms should reflect the legal entity that operates DMAICPROCESS.AI and the jurisdiction in which that entity is established.
